Action 1.1: LEXOMETRY

AIMS

The project has a social, economic and political objective.It concerns strengthening the integration of the European Union by supplementing the methods of developing common positions by the European Commission, other EU bodies and Member States, by using scientific identification of deep, long-term processes taking place in the legislative policy of the EU and the legislative policy of individual Member States.

STEPS

  • gathering people to carry out a query of data and its evaluation
  • a query of data concerning the premises of adopting the acts of the European Parliament and Council over the period 2010-2024
  • evaluation of data relating to 14 study problems
  • mathematical modelling of the evaluation results
  • assessment and presentation of the study outcome

PARTICIPANTS

Academics and PhD students of renowned universities with knowledge of professional English used in legislative work, including experts in law, economics and political science.

APPLICATIONS

The strategic application of the project results is to conduct an annually updated ranking of the compliance of the directions of legislative policies implemented by the legislatures of the EU Member States with the directions of legislative policies implemented by the European Union bodies.

Action 1.1: LEXOMETRY

a new method of research on legislation concerning subjective rights

The method concerns the examination of the state of legislative practice relating to various issues, including the creation of regulations concerning various categories of civil  rights, such as: human rights, election rights (state of democracy), employee rights, entrepreneur rights, etc.  The method is completely innovative and unique on a global scale, but proven and used for over 10 years. It has been called lexometry. It is qualitative and quantitative in nature. It is based on the assumption that the creation of law shows long-term tendencies, as it is subject to the law of supply and demand, just like the production of any other good, tangible or intangible. These tendencies are manifested in a periodic increase or a periodic reduction in the involvement of the legislator in the creation of legal acts that refer to specific reasons for creating the law: social, economic and political. It can also be said that the presented research is about determining the extent to which law-making is determined by the need to achieve specific goals of the legislative policy. The research carried out with the use of the research method led to the discovery of clear long-term trends in legislation, the course of which can be easily linked to specific economic, political and social situations. The research is of an expert nature and also includes the use of mathematical modeling tools. The results are presented using graphs. The conducted research on the state of Polish legislation currently covers the period from 1990 to the present, which required the aggregation of data on approx. 5,000 bills passed by the Polish parliament.

The most important advantages of the method (1) lexometry allows to identify deep phenomena occurring in the legislative policy, which cannot be determined on the basis of the analysis of individual, selected legal regulations;  (2) lexometry allows you to compare data on the state of legislation with data on the economic situation, which leads to establishing correlations of up to 90% (see example below). Data obtained by means of lexometry in different countries could be used for a comparative analysis of the situation in these countries, regarding the standards of observance of political rights (including the state of democracy), civil rights, the rights of entrepreneurs, etc. It is possible to create - thanks to such an analysis - a ranking list of countries, updated annually, which would indicate the position of each country in the field of law-making favorable or unfavorable to the protection of subjective rights.
